Introduction

Scholar Health is a brand operated by Scholar Education, Inc. ("Scholar Education," "we," "us," or "our"). References to "Scholar Health" in this Privacy Policy mean Scholar Education, Inc. doing business as Scholar Health.

At Scholar Health, we respect your privacy and are committed to protecting it as described in this privacy policy ("Policy" or the "Privacy Policy"). This policy describes the types of information we collect from you or that you provide when you use the Scholar Health website, forms, scheduling tools, and communications (together, the "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that information. Your use of the Services is also subject to our Terms of Service.

This policy covers the Scholar Health websites at joinscholarhealth.com and go.joinscholarhealth.com. Scholar Education, Inc. operates a separate K-12 education product under the Scholar Education brand, which has its own privacy policy.

Information we collect

For the purpose of this policy, Personal Information is information that identifies, relates to, or could reasonably be linked with or describes an individual or household, either directly or indirectly. We limit the data we collect to what is necessary to provide the Services.

  • Information you provide to us. When you request a consultation, book an appointment, or contact us, we collect your name, email address, mobile telephone number, and the information you enter on our intake and consultation forms. That includes information about the child you are seeking services for, such as their age, state of residence, and the concerns you want support with. You are not required to create an account to request a consultation.
  • Information collected automatically. When you visit our websites we collect device, browser, and usage information through cookies, pixels, and similar technologies, as described in the Cookies and similar technologies section below.
  • Information we receive from third parties. We receive information from the advertising platforms we use, so we can understand which campaigns brought you to our site. We receive information from scheduling, payment, and communications providers that support the Services. Where you ask us to coordinate payment through a scholarship or funding program, we exchange the information that program requires.


Health-related information

Some of the information you give us relates to health. Examples include the concerns you describe on an intake form and the evaluation services you request. We use this information to determine fit, to schedule services, and to coordinate care.

Clinical records created by a licensed clinician in the course of delivering care, including evaluation records and reports, are maintained by that clinician and in the clinical systems used to deliver care. Those records are governed by applicable healthcare privacy law and by the notice of privacy practices you receive as part of care. This Privacy Policy covers the information we collect through our websites, forms, scheduling tools, and marketing communications.

We keep marketing consent separate from consent to receive care. Agreeing to receive marketing does not affect the care you receive, and declining marketing does not affect the care you receive. We do not include information that identifies a specific health condition, diagnosis, or evaluation type in advertising audiences or in data shared with advertising platforms.


How we use information

We use the information we collect to:

  • Provide the Services you request, including consultations, scheduling, and evaluations.
  • Send appointment reminders, confirmations, rescheduling links, and care-related updates.
  • Send account notifications, billing and payment notices, and support responses.
  • Verify eligibility for a service or a payment method.
  • Respond to your questions and provide customer support.
  • Measure how our website, forms, and advertising campaigns perform, and improve them.
  • Deliver and measure advertising, including remarketing, as described below.
  • Detect, prevent, and address fraud, abuse, security incidents, and technical problems.
  • Meet our legal, regulatory, and contractual obligations.


SMS and text messaging consent

Scholar Education, Inc. does not share, sell, or otherwise disclose text messaging originator opt-in data or consent with any third parties, affiliates, or non-affiliates. This information is used solely to deliver the messages you have requested.

When you provide your mobile telephone number and opt in, we use it to send the message types described in our Terms of Service: appointment reminders, scheduling and rescheduling, consultation and evaluation confirmations, care-related updates, account notifications, billing and payment notices, and customer support responses. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

You may opt out at any time by replying STOP to any message. Reply HELP for help, or contact us at support@joinscholar.com. Your consent to receive text messages is not a condition of purchasing any goods or services.

Advertising and analytics

We advertise our services on third-party platforms and use analytics tools to understand how people find and use our websites. This section explains what that means for your information.

We use advertising cookies and similar technologies. These let us measure which ads and campaigns lead to consultations, and show our ads to people who have visited our site before. This is commonly called remarketing or interest-based advertising. Some of these technologies allow an advertising platform to recognize your browser or device across other websites and apps.

The advertising and measurement platforms we use are:

  • Google Ads and Google's advertising services, including DoubleClick: conversion measurement, view-through conversion measurement, and remarketing audiences.
  • Google Analytics 4: website and campaign analytics.
  • Google Tag Manager: tag management, which loads the technologies listed here.
  • Meta (Facebook and Instagram): advertising delivery, conversion measurement, and audiences.
  • Nextdoor: advertising delivery and conversion measurement.
  • HubSpot: website analytics, forms, campaign attribution, and consent management.

We may provide these platforms with a hashed version of an email address or phone number you gave us, so they can measure conversions and build or suppress audiences. Hashing is a one-way transformation, and we do not provide these platforms with information identifying a health condition, diagnosis, or evaluation type.

Under some state privacy laws, using advertising cookies and building advertising audiences in this way is treated as "sharing" personal information for cross-context behavioral advertising. We do not sell your personal information for money. You can opt out of this sharing as described in the Your privacy rights section.

Service providers

We share data with vendors who process information on our behalf to help us deliver the Services. We establish contractual limitations with them that restrict the extent and purposes for which they may process any personal information we disclose. They are permitted to process personal information solely on our behalf and in accordance with our instructions, and are required to maintain security measures consistent with our own.

  • HubSpot: customer relationship management, forms, scheduling, email, text messaging, and website hosting and analytics.
  • SimplePractice: practice management and clinical record keeping for the care our clinicians deliver.
  • Step Up For Students: scholarship funding program, where you ask us to coordinate payment through it.
  • Our text message aggregator and text messaging service providers, which deliver the messages you have opted in to receive.

For the avoidance of doubt, we do not sell personal data for money, and we do not provide your information to third parties for their own independent marketing purposes.

How we share information

We share information only in the categories below.

  • Clinicians and care teams. With the licensed clinicians and clinical staff who deliver the services you request.
  • Service providers. With the vendors listed above, who process information on our behalf.
  • Advertising and measurement partners. With the platforms listed in the Advertising and analytics section, for the purposes described there.
  • Funding and scholarship programs. With a scholarship or funding program, where you ask us to coordinate payment on your behalf.
  • Legal and safety. Where the law requires it, to respond to lawful requests, to enforce our Terms of Service, or to protect the rights, safety, or property of any person.
  • Business transfers. In connection with a merger, acquisition, financing, or sale of assets, subject to this Privacy Policy. We will inform you if such a transfer occurs, and you may request deletion of your data before it is transferred.
  • With your direction. With anyone else you ask us to share with.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, excluding aggregators and providers of the Text Message services.

Cookies and similar technologies

Our websites use cookies, pixels, tags, and similar technologies. A cookie is a small text file placed on your device that stores preferences and identifiers. The categories we use are:

  • Necessary cookies. Required for the site to function, including security and session handling. Blocking them may prevent parts of the site from working.
  • Preference cookies. Remember choices you have made, such as your language or a dismissed banner.
  • Analytics cookies. Collect information about how you use the site, such as which pages you visited and which links you clicked, so we can improve it.
  • Advertising cookies. Measure ad performance and support remarketing, as described in the Advertising and analytics section.

You can manage cookies through the consent banner on our site and through your browser settings. Most browsers accept cookies by default until you change your settings. If you block cookies, some parts of the Services may not work as intended.

We honor recognized opt-out preference signals, including Global Privacy Control, where the law requires us to.

Your choices

  • Advertising cookies. Use the consent banner on our site, or your browser settings, to limit advertising cookies. You can also opt out through the Digital Advertising Alliance and within your Google Ads settings and Meta ad preferences.
  • Text messages. Reply STOP to any message to opt out.
  • Marketing email. Use the unsubscribe link in any marketing message. Service-related email, such as appointment confirmations, continues because you need it to use the Services.
  • Your information. Email support@joinscholar.com to update or correct your information.


Your privacy rights

Except as otherwise provided, this section applies to residents of states with privacy laws that grant the rights described below. For purposes of this section, "personal information" has the meaning given to "personal data," "personal information," or similar terms under the applicable privacy law of the state in which you reside. Not all rights are available to all users, and if you are not a resident of a relevant state you may not be able to exercise them.

Depending on where you live, you may have the right to:

  • Access. Request the personal information we hold about you and details about how we have disclosed it.
  • Correction. Request that we correct inaccurate personal information.
  • Deletion. Request that we delete your personal information. Once we process a deletion request, we may be unable to provide access or support for past services.
  • Opt out of targeted advertising and sharing. Direct us to stop sharing your personal information for cross-context behavioral advertising.
  • Appeal. Appeal a decision we make about your request.

We will not discriminate against you for exercising these rights.

Verification. When we receive your request, we verify that you are the individual whose information we hold. That requires you to supply information we can compare against our records, or to respond through a communication method you previously gave us. Information you provide for verification is used only to verify your identity and is deleted once verification is complete.

Authorized agents. An authorized agent may submit a request on your behalf. We may require a copy of a valid power of attorney, or written and signed permission from you, plus information sufficient to verify your identity.

Exercising your rights. Email support@joinscholar.com with the subject line "Privacy Request." To opt out of the sharing of your personal information for targeted advertising, use the same address, adjust the consent banner on our site, or send a Global Privacy Control signal from your browser.

Some rights may be limited where we have an overriding interest or legal obligation to continue processing, or where an exemption applies. If we decline a request, we will tell you why, subject to legal restrictions.

Data retention

We keep personal information for as long as we need it to provide the Services, to meet legal, tax, and recordkeeping obligations, to resolve disputes, and to enforce our agreements. Clinical records are retained according to the requirements that apply to the clinician and the state where care is delivered. When we no longer need information, we delete it or de-identify it. Anonymized data that can no longer be linked to you may be retained for longer periods.

Security

We are dedicated to safeguarding the security of information obtained through the Services. We implement reasonable and appropriate administrative, technical, and physical safeguards to help protect it from unauthorized access, use, or disclosure, including encryption in transit and at rest, access controls, and vendor review.

No system is completely secure, and we cannot guarantee absolute security of your information. In the event of a data breach, we will make reasonable efforts to notify affected users in accordance with applicable laws and regulations. Children's privacy

The Services are intended for parents and legal guardians, not for children. We do not knowingly collect personal information directly from children through our websites, and our websites are not directed to children.

Information about a child is provided to us by a parent or legal guardian who is requesting services for that child. We use it to determine fit, schedule services, and coordinate care. We do not use information about a child for advertising, and we do not include it in advertising audiences.

If you believe a child has provided us information directly, email support@joinscholar.com and we will delete it.

Other sites and services

Our websites may link to websites and services operated by third parties. A link is not an endorsement of, or a representation that we are affiliated with, any third party. We do not control those services and are not responsible for their content or practices. We encourage you to read the privacy policy of each site you interact with.

Changes to this privacy policy

Scholar Education, Inc. reserves the right to change this Privacy Policy. If we make material changes, we will notify you as required by applicable law, update the date at the top of this page, and post the updated policy on the Services. Where applicable law requires it, we will seek your consent before implementing changes to our data collection practices.
