Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Scholar Health website, forms, scheduling tools, communications, and related services (together, the "Services"). Read them carefully. By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms include the Scholar Health Privacy Policy, which explains how we collect, use, and protect your information.

2. Who we are

Scholar Health is a brand operated by Scholar Education, Inc. ("Scholar Education," "we," "us," or "our"). References to "Scholar Health" in these Terms mean Scholar Education, Inc. doing business as Scholar Health.

3. Eligibility and parental authority

You must be at least 18 years old to use the Services. If you request services for a child, you confirm that you are the child's parent or legal guardian, or that you have the legal authority to act on the child's behalf and to consent to the services you request.

You agree that the information you provide about yourself and about any child in your care is accurate and current. We rely on that information to schedule and deliver services.

4. What Scholar Health provides

Scholar Health provides access to psychoeducational and related evaluation services, along with the tools you use to request, schedule, and manage them. Depending on the service you request, this may include:

  • A free consultation to discuss your situation and determine fit.
  • Scheduling and rescheduling of consultations, evaluations, and feedback sessions.
  • Evaluations delivered by licensed clinicians, including via telehealth.
  • Care coordination, account notifications, and service-related communications.
  • Written evaluation reports and related documentation.

Licensed clinicians are responsible for the clinical services they deliver and for their own professional judgment. Availability of specific services varies by state and by clinician licensure.

5. Not for emergencies

The Services are not for medical or mental health emergencies. If you or your child are experiencing an emergency, call 911 or go to the nearest emergency room. Do not use the website, forms, email, or text messaging to report an emergency. We do not monitor these channels continuously and cannot guarantee a timely response.

6. Consultations, scheduling, and cancellations

When you book a consultation or an evaluation, you agree to attend at the scheduled time or to cancel or reschedule in advance using the link provided in your confirmation message. We may send reminders before a scheduled appointment.

We may cancel or reschedule an appointment when a clinician is unavailable, when the requested service is not appropriate based on the information provided, or when the service is not available in your state. If we cancel, we will tell you and offer alternatives where we can.

7. Fees and payment

The initial consultation is free. Evaluations and other clinical services are paid services. We will tell you the applicable price before you book a paid service.

You are responsible for paying all fees for services you request. Accepted payment methods may include self-pay, Step Up For Students scholarship funds where you qualify, and HSA or FSA funds. Availability of any payment method depends on program rules and on your eligibility, which we do not control.

Unless we state otherwise in writing, fees are due at or before the time of service, and paid services are non-refundable once delivered.

8. Agreement to receive calls and text messages

Scholar Education, Inc., doing business as Scholar Health, may provide SMS services to facilitate communications regarding healthcare services, scheduling, care coordination, and other information related to the services you request or receive.

Types of messages you will receive

Appointment reminders, appointment scheduling and rescheduling, consultation and evaluation confirmations, care-related updates, account notifications, billing and payment notices, and customer support responses. Scholar Health does not send marketing or promotional text messages unless you separately opt in to receive them.

Your consent

By providing your mobile telephone number, you agree to be contacted by or on behalf of Scholar Education, Inc. dba Scholar Health at the mobile number you provide, including through calls and text messages, regarding healthcare services, scheduling, support, and other service-related communications. Your consent to receive text messages is not a condition of purchasing any goods or services.

By opting in to this service, you consent to receive recurring SMS and MMS messages, which may be sent using an automatic telephone dialing system.

Message frequency varies based on your interactions with Scholar Health and the services you receive.

Message and data rates

Message and data rates may apply. Check with your wireless provider for information regarding your messaging or data plan.

Carrier disclaimer

Carriers are not liable for delayed or undelivered messages.

How to opt out and how to get help

You may withdraw your consent at any time. Reply STOP to any message to opt out. After you reply STOP, you will receive a confirmation message and no further SMS messages will be sent unless you subsequently opt in again.

Privacy

Scholar Education, Inc. does not share, sell, rent, or disclose mobile information, text messaging originator opt-in data, or consent to any third parties, affiliates, or non-affiliates for marketing or promotional purposes. 9. Email communications

When you provide your email address, you agree that we may send you service-related email, including confirmations, reminders, account notices, and support responses. You may unsubscribe from marketing email at any time using the link in any marketing message. Service-related email continues even after you unsubscribe from marketing, because you need it to use the Services.

10. Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms.
  • Provide false, misleading, or fraudulent information.
  • Impersonate another person or misrepresent your authority to act for a child.
  • Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Services or their underlying systems.
  • Copy, scrape, reverse engineer, or resell any part of the Services.
  • Upload malicious code or content that infringes the rights of others.

We may suspend or terminate your access to the Services at any time if you violate these Terms or if we reasonably believe your use puts the Services, our clinicians, or other users at risk.

11. Intellectual property

Scholar Education, Inc. owns the Services and all related content, including text, graphics, logos, trademarks, software, and evaluation materials, except for content you provide and content licensed from third parties. We grant you a limited, personal, non-transferable license to use the Services for their intended purpose.

Reports and documents we deliver to you are for your personal use in connection with your child's education and care. You may share them with schools, clinicians, and other parties at your discretion. You may not resell them or present them as your own work.

12. Third-party services

The Services rely on third-party providers for scheduling, communications, payments, and analytics. The Services may also link to third-party websites. We do not control those services or websites and are not responsible for their content, policies, or practices. Your use of a third-party service is governed by that provider's own terms and privacy policy.

13. Disclaimers

The Services are provided "as is" and "as available." To the fullest extent permitted by law, Scholar Education, Inc. disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Website content is for general information. It is not medical, psychological, legal, or educational advice, and it does not create a clinician-patient relationship. An evaluation is a first step that produces findings and recommendations. It does not guarantee any specific outcome, including a diagnosis, an IEP, a 504 plan, a school placement, or any accommodation. Schools and other institutions make those determinations under their own rules.

We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that messages will be delivered.

14. Limitation of liability

To the fullest extent permitted by law, Scholar Education, Inc. and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the Services.

To the fullest extent permitted by law, our total liability for all claims relating to the Services is limited to the greater of the amount you paid us for the service giving rise to the claim in the 12 months before the claim, or one hundred US dollars ($100).

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, the limitations above apply to the fullest extent the law allows.

15. Indemnification

You agree to indemnify and hold harmless Scholar Education, Inc. and its officers, directors, employees, contractors, and agents from any claim, demand, loss, liability, or expense, including reasonable attorneys' fees, arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. You and Scholar Education, Inc. agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

17. Changes to these terms

We may update these Terms from time to time. When we do, we will change the effective date at the top of this page. Material changes take effect when we post them, or on a later date if we say so. Your continued use of the Services after a change means you accept the updated Terms.

18. Severability and entire agreement

If any provision of these Terms is found unenforceable, the rest stays in effect. These Terms, together with the Privacy Policy and any service-specific agreement you sign, are the entire agreement between you and Scholar Education, Inc. regarding the Services.
